Use the next letter authorization sample when you need a Sworn Statement of the Property Owner declaring that all payments are in order.

With this document you will be one step ahead for getting the Moving Sworn Statement.

In this, the Owner of the property declares that all the payments are ok, including the rent of the last month and any other service related. Thereby is no legal impediment for moving your goods form the property.

According to the legal provisions in force, a Sworn Statement (Salvoconducto) signed before a Public Notary must accompany any local or international relocation in Chile.

This document states that there is no legal or contractual impediment to perform the move and must indicate the origin and destination address.

Decapack reserves the right to refuse the service if Moving Sworn Statement (Salvoconducto de Mudanza) is not available and cancellation charges will apply.

Why? The Sworn Statement must be available during the day of the move; it is required to be carried by our driver. Without this Statement, we risk jail punishments as well as goods confiscation.

• Where do I get it?
The Moving Sworn Statement must be requested by the owner of the household goods to a Notary within the County (Comuna) of their
origin residence.

• How long does the processtake?
It is an immediate process.

• How much does it cost?
Around $2.000-$4.000 Chilean Pesos (USD 4-8 approx.).

• How many days in advance should it be requested?
The Moving Sworn Statement has a validity of 5 days so it should be requested just before beginning the move. If there is a move planned
ahead, the Statement could be requested in advance clearly indicating on the Statement the specific day of the move. In this case
the Statement will only be valid for that date (not valid for 5 days from that date).

• What documents should be presented to the Notary?
The notary will require you to submit some documents, depending on whether you are the owner or tenant of your residence.

If you are the owner:
– Original receipt of the last payment of house taxes or deed of your home in yourname.
– Three paid utility bills such as electricity, water, gas, phone, etc. in yourname.
– Original ID card

If you are a tenant:
– Signed letter from the owner authorizing the move from the residence. (Decapack can provide a template upon request or you could find it in the last page of the pdf document in this article)
– Copy of the lease or rental Contract
– Proof of payment of the last rental monthperiod
– Three paid utility bills such as electricity, water, gas, phone, etc.
– For apartments, the last receipt of common expenses must beshown
– Original ID card

PARKING PERMIT
Some locations including Las Condes, Vitacura, Providencia and Santiago request a parking permit, which must be obtained
presenting a document called Sworn Statement (Salvoconducto). Decapack can obtain the parking permit, however the Sworn Statement (Salvoconducto) must be obtained by you and sent to us at least one week before the service begins. For details about
this document please ask us.

TRANSLATION OF THE SALVO CONDUCTO DE MUDANZA
The “Salvoconducto de Mudanza” is not a document that we produce so we do not provide a template to our customers. This document is produced by the Notary, based on supporting information.
Each local Notary may have its own format, but the content is similar. Because of the varying formats, we do not provide a template.

The local notary will know how to process the Moving Sworn Statement (Salvoconducto) and you should not have to provide them with a template or sample.

However, we can provide sample from previous customers upon request. Legal terms do not translate well from Spanish to English, however the typical translation of a standard Moving Sworn Statement (Salvoconducto) is below.

• For International Moves:
“I hereby declare under oath that in my capacity as a tenant I will be moving my personal belongings from the property located in
origin address to the Decapack Warehouse (Av. Claudio Arrau 9452, Pudahuel, Santiago), and then internationally to destination
country. An Authorization of the owner of the property has been displayed. I finally state that there is no legal, contractual, or
judicial impediment to perform this move. Place and date of signature”

• For Intra-Chile Moves
“I hereby declare under oath that in my capacity as a tenant I will be moving my personal belongings from the property located in
origin address to the destination address. An Authorization of the owner of the property has been displayed. I finally state that
there is no legal, contractual or judicial impediment to perform this move. Place and date of signature”

As you can see, the lease must get an authorization from the leaser. We do provide a template that our customers can use to
request this authorization from the owner of the property.

Again keeping in mind that legal terms do not translate well from Spanish to English, the translation of this authorization is:
“I, complete name owner, national identification number, owner of the property located in address, declare hereby that the tenant or leasee complete name, national identification number, has no outstanding payments regarding this lease contract, including the last period lease payment and all utilities. Therefore, there is no legal, contractual or judicial impediment to move his belongings from the property. I issue the present declaration according to Law number 20.227 to enable the lease to request the Sworn Statement.”

The document is also a signed declaration that states: “I, the customer hereby declares that my shipment contains no “Hazardous” or “Restricted” goods as described in this section. Where such non permitted or restricted items are found,
DECAPACK. reserves the right to remove these items and dispose of them accordingly without reference to me. In such circumstances I will not be liable for any compensation, nor will DECAPACK.

an airline, handling agent, consolidator etc, these charges will be passed on to me together with an administration fee, and the shipment will be delayed until such charges are paid.”

As a general rule, import of new and used goods to Chile is subject to a 6% and 9% duty over CIF value respectively. In addition a 19% VAT (Value Added Tax) applies over CIF value plus duties, so the compound tax is 29.7% for used goods and 26.14% for new goods.

The customs valuation of HHG considers depreciation for use, and should be comparable to the value of similar articles in the country of origin.
